Secretariat of Karnataka Legislative Council

The Secretariat of Karnataka Legislative Council was set up pursuant to the provisions contained in Article 187 of the Constitution. The said Article, which provides for a separate secretarial staff for each House of Parliament, reads as follows:- “187. Secretariat of State Legislature "-

  1. The House or each House of the Legislature of a State shall have a separate secretarial staff: Provided that nothing in this clause shall, in the case of the Legislature of a State having a Legislative Council, be construed as preventing the creation of posts common to both Houses of such Legislature. 
  2. The Legislature of a State may by law regulate the recruitment, and the conditions of service of persons appointed, to the secretarial staff of the House or Houses of the Legislature of the State. 
  3. Until provision is made by the Legislature of the State under clause (2), the Governor may, after consultation with the Speaker of the Legislative Assembly or the Chairman of the Legislative Council, as the case may be, make rules regulating the recruitment, and the conditions of service of persons appointed, to the secretarial staff of the Assembly or the Council, and any rules so made shall have effect subject to the provisions of any law made under the said clause

FUNCTIONS

The Karnataka Legislative Council Secretariat functions under the overall guidance and control of the Chairman, Rajya Sabha. The main activities of the Secretariat inter alia include the following :-

(i) providing secretarial assistance and support to the effective functioning of the Karnataka Legislative Council.

(ii) payment of salary and other allowances to the Members of Karnataka Legislative Council;

(iii) providing amenities as admissible to Members of Karnataka Legislative Council;

(iv) servicing the various Legislative Council Committees;

(v) preparing research and reference material and bringing out various publications;

(vi) recruitment of manpower in the Legislative Council Secretariat and attending to personnel matters; and

(vii) preparing and publishing a record of the day-to-day proceedings of the Karnataka Legislative Council and bringing out such other publications, as may be required concerning the functioning of the Karnataka Legislative Council and its Committees.

In the discharge of his constitutional and statutory responsibilities, the Chairman, Karnataka Legislative Council is assisted by the Secretary-General, who holds the rank of the Cabinet Secretary to the Government of Karnataka. The Secretary-General, in turn, is assisted by senior functionaries at the level of Secretary, Additional Secretary, Joint Secretary and other officers and staff of the Secretariat. Based on the recommendations of the Legislative Pay Committee way back in 1974, the Secretariat was restructured on functional basis into the following Services, which cater to the specific needs of the House and its Committees.

(i) The Legislative, Financial, Executive and Administrative (LAFEA) Service

(ii) The Library, Reference, Research, Documentation and Information (LARRDI) Service

(iii) The Verbatim Reporting Service

(iv) The Simultaneous Interpretation Service

(v) The Editorial and Translation Service

(vi) The Private Secretaries and Stenographic (PSS) Service

(vii) The Printing and Publications (P&P) Service

(viii) The Watch & Ward, Door Keeping and Sanitation Service

(ix) The Drivers and Despatch Riders Service

(x) The Messenger Service

The then Karnataka Legislature Secretariat was under the administrative control of Department of Law & Parliamentary Affairs.

The Government of Karnataka has accorded an independent status to the Karnataka Legislature Sectretariat vide Government Order No: LAW/67/LGR/79, dated 29th September, 1984.

Legislature Secretariat was bifurcated in to two independent Secretariat viz., Legislative Assembly Secretariat and Legislative Council Secretariat with effect from 02-04-1998, vide Notification No.ADM-I/51/KLS/98. The recruitment and conditions of service of Legislative Assembly Secretariat staff are to be regulated by law made by the State Legislature. In the absence of such a law, they are to be regulated by rules made by the Special Board.

The recruitment and conditions of service of Karnataka Legislative Assembly Secretariat staff is regulated by the Karnataka Legislative Assembly Secretariat (Recruitment and Conditions of Service) Rules, 2003 and amendments made from time to time by the Special Board. According to these Rules, the Karnataka Legislative Assembly Secretariat staff consists of the post of Secretary and a number of Gazetted and Non-Gazetted posts as specified in Schedule-I to the said Rules.

The Special Board consisting of the Chief Minister, the Chairman of the Karnataka Legislative Council, the Speaker of the Karnataka Legislative Assembly, the Minister incharge of Parliamentary Affairs and Minister in charge of Finance. The meeting of the Special Board shall be presided over by the Speaker.
